  • Representation of Fruit of the Loom and Union Underwear in preference litigation under the U.S. Bankruptcy Code for amounts in excess of 1 million dollars.

Representative Litigation

 
  • In re Soards and In re Morrison, 344 B.R. 829 (Bankr.W.D.Ky.2006). Post Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 litigation involving vehicle purchase money security interests and applicability of U.S. Supreme Court's decision in Till v. SCS Credit Corp to determine what interest rate creditors are entitled to under Chapter 13 plan. United States Bankruptcy Court for Kentucky agreed with creditor's position that contract interest rate is irrelevant in determining present value of plan payments as mandated under the Bankruptcy Code and Till still remains good law.
